These terms govern every order placed with Dirtbag Studio and every use of this site. They are written to be read, not survived. Nothing in them removes the rights Dutch and EU consumer law gives you.

Terms of sale
01 The contract.
Placing an order is an offer to buy. The contract exists once we send the order confirmation email. If we cannot fulfil an order, a sold-out format, a plant we will not ship into a heatwave, an address we cannot reach, we tell you and refund in full.
02 Prices and tax.
Prices are in euros and include VAT where it applies. Orders shipped outside the EU may attract import duty and local tax on arrival, which is yours to pay. Delivery cost is shown before you confirm, never after.
03 Payment.
Card details are entered into a Stripe field on our checkout page and go straight to Stripe. We never see or store your full card number. We charge when the order is confirmed; if the payment fails or is reversed, the contract ends there.
04 Delivery.
The times by region on the shipping page are estimates, not guarantees: a courier delay is not a breach of these terms. Risk passes to you on delivery. If a parcel arrives damaged, photograph it and write to us within fourteen days.
05 A living wall.
The canvas ships without soil or plants: what grows in it is yours, chosen and bought by you. How it looks over time follows from your plant and your care, and the Plants and care page is there to help. Nothing alive is part of this contract.
06 Cancellation and returns.
You may return a canvas within 60 days of delivery, which goes well beyond the statutory EU withdrawal period. The full procedure, and the short list of exceptions, is on the returns page. Your statutory right to withdraw is unaffected by anything written here.
07 Warranty.
Everything we sell carries the statutory legal guarantee of conformity under Dutch and EU consumer law, which costs you nothing and lasts as long as you could reasonably expect the goods to last. Details are on the warranty page. We do not offer a fixed-term commercial warranty on the hardware on top of that, and we would rather say so than print a number we cannot yet stand behind.
08 What you post.
Reviews, comments and photographs you send are read by a person before publication. Post only what is yours to post, and keep it civil; we may decline or remove anything abusive, deceptive or unrelated. By submitting, you let us publish, translate and shorten it on this site: you keep ownership, and you can ask us to take it down.
09 Our work.
The Dirtbag Studio name, the designs, the photography, the text and the code on this site are ours. Read them, quote them with credit, link to them. Do not resell them, scrape them at scale, or pass them off as your own.
10 Liability.
We are responsible for what we sell you and for what we get wrong. We are not liable for damage caused by ignoring the mounting instructions, hanging a canvas on an unsuitable surface, or overwatering. Nothing here limits liability for death, personal injury, or anything else that cannot lawfully be limited.

These terms are governed by the law of the Netherlands , whose courts have jurisdiction. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings in your own courts. We would much rather settle it by email first.

If a clause here is unclear, ask before you order rather than after. Write to hello@dirtbagstudio.com and we answer in plain language: and if it turns out the clause is the confusing part, we rewrite it.
